ARTICLE 1 IDENTITY CONTROLLER

This privacy policy contains information on the processing of personal data by the controller, PLOUVIER GROUP, a public limited company under Belgian law, having its registered office at Noorderlaan 79, box 1, 2030 Antwerp (Belgium) and registered in the Crossroads Bank for Enterprises under the number 0404.542.062, register of legal entities Antwerp, department of Antwerp (hereinafter “Plouvier”).

Plouvier processes personal data in accordance with the Belgian Act of 30 July 2018 on the protection of natural persons regarding the processing of personal data and the European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data (“General Data Protection Regulation” / “GDPR”).

By accessing and using Plouvier’s website, submitting an application or entering into a partnership with Plouvier, you acknowledge you have been informed on the processing of your personal data.

ARTICLE 2 THE PERSONAL DATA WE COLLECT, THE PURPOSES AND THE LEGAL GROUNDS

Plouvier processes the following personal data in the course of its activities:

• Customer data: By concluding an agreement with us, we process the following personal data including, among others: name, address, email address, telephone number, VAT number, payment details and any other data you voluntarily submit to us. Customer data is processed in order to provide the requested services, comply with the agreement and to manage our accountancy, based on the performance of a contract and compliance with our legal accounting obligations.

• Supplier data: In the event you provide goods or services to us, we process the following personal data including, among others: name, address, email address, telephone number, VAT number, bank account number and any other data you voluntarily submit to us. Supplier data is processed to receive a quotation, to pay invoices, to communicate and to manage our accountancy, based on the performance of a contract and compliance with our legal accounting obligations.

• Communication data: In the event you contact us by email, telephone or by submitting a contact form on our website, we process the following personal data: name, email address, telephone number and any other data you voluntarily submit to us in the course of the communication. These personal data are processed to answer your question and handle your request, based on the performance of a service you have requested for.

• Applicant data: In case you apply for a vacancy at Plouvier, the following personal data may be processed: name, address, email address, CV, motivation letter and any other data you voluntarily submit to us. These personal data are processed on the basis of our legitimate interest in recruiting new employees and managing the application process.

• Cookies: By visiting our website we can collect personal data, such as your IP address, search behavior, session duration through the use of cookies and similar technologies. These personal data are only processed with your explicit consent and are used to improve our website and to include personal data in anonymous statistics.

ARTICLE 3 RECIPIENTS OF PERSONAL DATA

In accordance with mandatory laws or regulations or based on a court order we may share your personal data with public authorities, tax and customs authorities, financial investigation services and judicial and police services.
In addition, we share your personal data with third parties, such as external service providers, such as software suppliers, accountancy firms and legal advisers. In the event of a change of control at Plouvier or a (partial) transfer of our activities to another entity, your personal data will be transferred to guarantee the continuity of our services.

ARTICLE 4 RETENTION PERIOD

We store personal data as long as it is necessary for the purposes of the processing and in accordance with legal requirements. Customer and supplier data may be stored for up to 10 years after termination of the agreement, given our legitimate interest in maintaining documentary evidence in the event of legal proceedings. In addition, due to legal accounting obligations, Plouvier may store accounting and tax documents for 10 years following the taxable period to which they relate.

ARTICLE 5 THE SECURITY OF PERSONAL DATA
In order to guarantee the security of the processing of your personal data, we have taken appropriate technical and organizational security measures to protect the personal data against unauthorized destruction, accidental loss and other unauthorized processing of personal data. Plouvier ensures that the data is stored in a secure environment, protected by a combination of organizational and technical measures, such as

  • User and Access Management according to least privilege access principle
  • Patch management on all IT systems
  • Monitoring on al IT systems
  • EDR anti-virus on all IT systems
  • Firewall in place on every Plouvier site
  • Backups from the local and Microsoft 365 environment according to the 3 – 2 – 1 rule and the grandfather, father, son principle
  • MFA on Microsoft 365 accounts
  • Conditional access configured in the Microsoft 365 environment
  • User awareness training
  • Phishing simulations
  • VPN configuration to access data from outside the Plouvier network


ARTICLE 6 DATA SUBJECT’S RIGHTS

In exercise of your rights under the GDPR, you have the right to request us the following:

  • Right to information and access to personal data, including a copy of the personal data undergoing processing;
  • Right to restrict, rectify and erase (‘right to be forgotten’) personal data under specific circumstances;
  • Right to object to the processing of your personal data, in the event this is based on a legitimate reason. In any event you will have the right to object to the use of personal data for direct marketing purposes;
  • Right to data portability: you have the right to receive your personal data in a structured, digital and readable format or to request the transfer of your personal data to another controller, insofar as this is technical feasible;
  • Right to withdraw your consent at any time: to the extent that the processing is based on your explicit consent;
  • Right to lodge a complaint with the Belgian data protection authority “Gegevensbeschermingsautoriteit” (GBA), Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be, if you consider that your rights regarding the processing of your personal data are not respected.
